How to vote

Homeowners may vote at the annual meeting in person or appoint someone to vote for their lot by proxy.

Option 1

Attend and vote in person

Go to the annual meeting on October 15 and cast your ballot there. If you already returned the Association’s proxy form, the form says your attendance revokes the proxy, so be prepared to vote in person.

Option 2

Vote by proxy

Complete the orange proxy form and give the signed original to a reform team member. They will hand it in at the annual meeting so your lot can still be represented if you cannot attend.

Complete your orange proxy form

A proxy lets you appoint someone else to cast your lot’s vote at the annual meeting if you cannot attend. Use the form mailed to you by the Association and complete every required field.

  1. Name your proxy. On the first blank, labeled “name of assignee,” write Samuel Scott Farwell. Do not leave this line blank.
  2. Add your lot address. On the next blank, labeled “your address,” write the address of your Brighton Forest lot.
  3. Date and sign. At the bottom, date and sign the form. On the line below, print the owner name or names and the property address.
  4. Keep a copy. Take a clear photo or scan of the entire signed form before giving it to a reform team member.
The advance-return deadline has passed. Give the signed original to a reform team member before the annual meeting so it can be submitted in person.

Give your proxy to a reform team member

The advance-return deadline has passed. Completed proxies must now be given to a reform team member for in-person delivery at the annual meeting.

Hand over the signed original

Write Samuel Scott Farwell as your proxy, complete every required field, sign and date the form, and take a clear photo. Then give the original to a reform team member, who will submit it at the annual meeting.

Do not email or mail the form now. Give the signed original directly to a reform team member for in-person submission.

What you are voting for

Homeowners will elect the members of the Brighton Forest Board of Directors. Each lot gets one vote.

How the election is supposed to work

The Brighton Forest Bylaws, North Carolina law and Robert’s Rules establish the following sequence.

  1. The annual meeting begins at 7:00 p.m. on October 15

The Bylaws schedule the annual meeting for the third Thursday of October and identify the election of directors as one of its purposes.

“An annual meeting of the Association shall be held for the purpose of electing members of the Board of Directors… The annual meetings shall be held at 7:00 p.m. on the third Thursday of October of each year…” Brighton Forest Bylaws, Article IV §2. Open the complete Bylaws
  2. Homeowners elect the directors at the annual meeting

Homeowners cast their votes in person or through valid proxies. The candidates receiving the highest numbers of votes fill the available Board seats.

“The directors shall be elected at the annual meeting of the Association; and those candidates who receive the highest number of votes shall be elected.” Brighton Forest Bylaws, Article V §4. Open the complete Bylaws
  3. The vote totals are reported and the chair declares the result

North Carolina law makes Robert’s Rules the default meeting procedure unless the Bylaws provide otherwise. Under that procedure, the tellers’ report is read, the chair declares each election result and the report becomes part of the minutes.

“Except as otherwise provided in the bylaws, meetings of the association and the executive board shall be conducted in accordance with the most recent edition of Robert’s Rules of Order Newly Revised.” N.C.G.S. §47F-3-108(c)
“The result is always declared by the chair, who also reads the tellers’ report before he does so.” Robert’s Rules of Order Newly Revised, 12th ed., §45:39. Open the source excerpt
  4. The elected directors take office when the election becomes final

Robert’s Rules makes an accepted election final immediately. North Carolina law then places the elected Board members in office upon election.

“An election to an office becomes final immediately…” Robert’s Rules of Order Newly Revised, 12th ed., §46:46. Open the source excerpt
“The executive board shall elect the officers. The executive board members and officers shall take office upon election.” N.C.G.S. §47F-3-103(e)
  5. The newly elected Board meets immediately afterward

Once the director election is final, the newly constituted Board holds its required regular meeting at the same location. The Board may elect the Association’s officers there.

“A regular meeting of the Board shall be held immediately after and at the same place as the annual meeting or substitute annual meeting of the Association.” Brighton Forest Bylaws, Article VI §2. Open the complete Bylaws
“All other officers of the Association shall be elected by the Board of Directors, and such elections may be held at the regular annual meetings of the Board…” Brighton Forest Bylaws, Article VII §2. Open the complete Bylaws
